Terms of Service

These Terms of Service (“Terms”) govern your use of the Verdik mobile application and website (collectively, the “Service”) operated by Verdik (“we”, “us”, or “our”). By downloading, accessing, or using Verdik, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use Verdik. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these requirements.

2. Not Medical Advice

Verdik is an educational tool, not a medical device or substitute for professional medical advice. The nutrition information, AI-generated insights, article summaries, and food data provided through the Service are for general informational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or health condition.

Always seek the advice of a qualified healthcare provider before making changes to your diet, supplement regimen, or health management plan. Never disregard professional medical advice or delay seeking it because of information you read in Verdik.

3. User Accounts

You may create an account using your email address or a supported social sign-in provider. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use at support@verdik.co.

You agree to provide accurate, current, and complete information. We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used fraudulently.

4. Subscriptions and Billing

Verdik offers a free tier and paid Premium subscription plans. Subscriptions are billed through the Apple App Store or Google Play, depending on your platform. All billing, refunds, and subscription management are subject to the respective platform's terms.

  • Free Trial: Premium plans include a 7-day free trial for new subscribers. You will not be charged until day 8. Cancel anytime before the trial ends to avoid charges.
  • Auto-Renewal: Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal.
  • Price Changes: We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance.
  • Refunds: Refund requests are handled by the App Store or Google Play per their respective policies.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or extract source code from the app
  • Use automated means (bots, scrapers) to access the Service without our permission
  • Transmit malware, spam, or harmful content through the Service
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the integrity or performance of the Service
  • Share your account credentials with third parties

6. Intellectual Property

The Verdik name, logo, app design, editorial content, and all other materials in the Service are owned by Verdik or our licensors and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

Nutritional data and food information may be sourced from third-party databases and is subject to their respective licenses. Article content is original editorial work.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Verdik, you consent to the data practices described in our Privacy Policy.

8. Third-Party Services

Verdik integrates with third-party services including Supabase (database and auth), Stripe (payment processing), and AI providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERDIK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Verdik and its officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 2, 6, 9, 10, and 11) will survive.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of courts located in Delaware for resolution of any disputes.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date and, where appropriate, by sending an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
